Twin Wireless LLC ("Twin Wireless") strives to maintain the availability of its Services and Platform. However, Twin Wireless reserves the right to suspend or limit access to the Services and Platform for maintenance, repairs, or development purposes. Twin Wireless shall not be liable for any damages resulting from a User's inability to access or use the Services or Platform.
Users acknowledge and agree that their use of the Services is at their sole risk. The Platform is provided on an "as is" and "as available" basis, with all faults. Twin Wireless expressly disclaims all warranties, representations, and conditions, whether express or implied, including but not limited to, the implied warranties or conditions of merchantability, fitness for a particular purpose, and non-infringement.
Twin Wireless makes no warranty or representation regarding the suitability, reliability, or effectiveness of the Services. Users understand and accept that the Services may be subject to delays, interruptions, or cancellations. Twin Wireless shall not be liable for any losses or damages resulting from the use of the Services.
Twin Wireless may offer beta features or tools for experimental purposes, without any warranty. Users acknowledge and agree to use such features at their own risk.
Twin Wireless utilizes third-party services for Platform functionality. Users agree that Twin Wireless shall not be liable for the conduct of third parties, including operators of external sites.
Concerning the Products
Twin Wireless acts solely as an intermediary and is not the Seller or reseller of Products offered through the Platform. Sellers are fully responsible for the quality and warranties of their Products. Twin Wireless makes no warranty regarding the quality or accuracy of Product information obtained through the Platform.
Twin Wireless offers a one-month warranty for Products sold through the Platform. This warranty covers defects in materials and workmanship under normal use. Twin Wireless shall not be liable for damages resulting from misuse or improper handling of Products.
Disclaimer
Twin Wireless shall not be liable for any indirect, incidental, special, exemplary, or consequential damages arising from the use of the Platform. This includes damages for loss of use, data, or profits, whether or not Twin Wireless has been advised of the possibility of such damages.
Twin Wireless's liability is limited to direct damages exclusively attributable to contractual faults by Twin Wireless. Any claims for damages shall not exceed the total amount paid by the Buyer through the Platform in the preceding one-month period.
Applicable Law and Dispute Resolution
These Terms of Service shall be governed by the laws of the State of Indiana, with judicial jurisdiction in Indianapolis, Indiana.
Users may report complaints related to the Services to Twin Wireless or the Division of Consumer Protection of the State of Indiana. Disputes shall be resolved through arbitration in accordance with the Federal Arbitration Act and the American Arbitration Association rules.
Any claims and disputes not subject to arbitration shall be resolved in courts located within Indianapolis, Indiana.
TWIN WIRELESS LLC USER'S LIABILITY
User's Obligations
Users agree to use the Services and Platform in compliance with the Terms of Service and applicable laws. Users shall not violate any law, regulation, or public policy.
Indemnification
Users agree to indemnify and hold Twin Wireless, its parent companies, subsidiaries, affiliates, officers, employees, agents, partners, and licensors harmless from any losses, costs, liabilities, and expenses arising from their misuse of the Platform or violation of these Terms of Service.
This indemnification obligation survives the termination of the user's account or access to the Platform.

Disputes between Users and Twin Wireless shall be governed by the laws of the State of Indiana, with judicial jurisdiction in Indianapolis, Indiana.
